That was on a 5-4 vote with Justice Kennedy casting (as he often does) the swing vote. It could have gone the other way. Right now even with Obama's pick, the court is 4 liberal, 4 conservative and Kennedy in the middle. All it would take prior to 2010 or 2012 is to lose one of the conservatives or lose Justice Kennedy and there will be no stopping those who would establish a socialistic autocracy. Even those on the left should consider the danger of any point of view having absolute power.
