good could come out of Trump conviction of exercising the First Amendment. They called it civil war in in 1860's. Only way to fix the liberal agenda is to nip it in the bud.

Ya know, if you are on the side I think your on, it didn't come out so well back then. Ya know even suggesting a rebellion against the US government can get your silly ass in a whole heap of trouble, right. The Constitution:
14th Amendment, Section 3:

Federalist Society Law Professors:

Tribe & Luttig praise the forthcoming University of Pennsylvania law review article by two Federalist Society conservative law professors: William Baude of the University of Chicago and Michael Stokes Paulsen of the University of St. Thomas who conclude that Trump is ineligible to run again.

How would it work?
Individual actions would arise state by state likely under what are known as quo warranto laws which give a broad variety of stakeholders the ability to bring such actions. A good analysis of these is set forth in

Criticism of Section 3 is Off-Base
Critics of the process who claim that it is legally flawed because it is untested and would be unwieldy miss the mark. First, it is not untested. Second, the fact that all 50 states have different laws hardly supports an argument that a Constitutional provision is flawed.

Political Effect
Some concern may exist that any such efforts might backfire by either further energizing Trump's base. While that is likely true, in the short term it might allow Trump to more easily capture the Republican nomination that is likely to happen anyway. The real political damage to Trump would be in the general election where such efforts if successful in even one of the battleground would be crippling to Trump's ability to win the general election. Moreover, the timing of such actions and likely appeal to the Supreme Court make the effect far more likely to be felt in the general election.



A federal court judge in Fort Lauderdale on Thursday dismissed a lawsuit challenging Donald Trump's 2024 presidential candidacy under the 14th Amendment.

The lawsuit, filed a week ago, questioned Trump's ability to appear on the Florida presidential primary ballot next year, owing to his alleged role in the Jan. 6 violence at the U.S. Capitol.

In her swift dismissal of the case, Judge Robin Rosenberg, who was appointed to the bench by President Barack Obama, did not determine the 14th Amendment's applicability in Trump's case.
